Resolution to establish an
election
Account and fund for the
first Election of
the Legislative Body of
the Kingdom of Hawai’i
WHEREAS, it is the intent of the Interim Provisional Government Council to promote and hold a public election for the first Legislative body of and for the reinstated Kingdom of Hawai’i; and,
WHEREAS, the first election of the legislative body will need funds to defray and pay expenses for the printing, distribution, and collection of citizen registration forms, voter registration forms, candidate registration forms, voting ballots, polling records, locked voting boxes, and such other necessary election expenses as will be incurred; and,

WHEREAS, it will be and is necessary to establish a separate account for these same election funds; and,
WHEREAS, it will be necessary to keep said election funds separate and apart from any other funds so that there will be no reason believe that to the election funds were meant to be used or were used to promote or further any partisan group, agenda, ideology, or position; and,
WHEREAS, said election fund account will allow other people and organizations to make such donations and contributions for the first election of the reinstated Kingdom of Hawai’i; and,
WHEREAS, the identity of those that choose to make such donations and contributions to defray and pay the necessary expenses and costs of said election should not be publicly disclosed until after the reinstatement process of the Kingdom of Hawai’i is completed; and,
WHEREAS, should it happen that the first election of the Legislature of the reinstated Kingdom of Hawai’i does not take place by January 1, 2000, the funds so donated or contributed for the express purpose of holding and completing said election should be returned to each of the parties that made such donations or contributions; and,
WHEREAS, an independent, competent, impartial party should be found to use the election fund account solely for purpose of paying such election expenses as are incurred, and that said party keep a complete and accurate accounting of such all funds as are received in and paid out of said account; and,

WHEREAS, the aforesaid independent, competent, and impartial party should and shall be required to make a true, correct, and complete accounting of said election funds and shall submit of the same to the Minister of Finance, INTERIM PROVISIONAL GOVERNMENT; and,
WHEREAS, the aforesaid independent, competent, and impartial party shall be required to make a true, correct, and complete accounting, of said election funds and to submit said accounting, along with any remaining balance to the newly elected Legislature within one hundred eighty (180) days after the first election is completed; and,
WHEREAS, if the election of the Legislature of the Kingdom of Hawai’i does not occur before January 1, 2000, the aforesaid independent, competent, and impartial party should and shall be required to make a true, correct, and complete accounting of said election funds and to submit said accounting to the Minister of Finance by February 1, 2000, and further, shall therewith relinquish any and all right, claim, interest, and control of funds remaining in the election fund account, and shall transfer and return the same to the Minister of the Finance with all records and papers concerning the same.
Be it Resolved:
That the Minister of Finance shall establish and open a separate account entitled “Election Fund Account”; and,

That the Minister of Finance shall establish an address to receive such donations and contributions, and immediately upon receipt of such funds shall insure that such funds are deposited in the Election Fund Account; and,
That the Minister of Finance shall locate and solicit estimates or bids from three (3) different impartial bidding parties to administer and account for any payments made from the Legislative Election Fund Account; and,
That the Minister of Finance shall prepare and make a monthly accounting and report of the funds deposited in the Election Fund Account, and shall make the same available to the INTERIM PROVISIONAL GOVERNMENT at the monthly general meeting of the INTERIM PROVISIONAL GOVERNMENT; and,
That the Advocate General shall draft a contract consistent with this resolution to be presented to the three (3) impartial bidding parties who are solicited to take control of and pay the election costs out of the Election Fund Account; and,
That any appropriation of funds for election costs, including but not limited to, printing, distribution and collection of forms, the purchase, acquisition or renting of equipment necessary for the completion of the election, etc., shall be subject to the passage of an appropriate resolution and approval by the general body of the INTERIM PROVISIONAL GOVERNMENT COUNCIL; and,

That each voting District shall keep a true, correct, and complete accounting of receipts and expenditures pertaining to all election costs, and shall submit such accounting and receipts to the contracted impartial party for payment or reimbursement and,
That if the election of the Legislature of the Kingdom of Hawai’i is not completed by January 1, 2000, the Minister of Finance shall take possession and control of all the funds remaining in the Election Fund Account on or before February 1, 2000, and shall forthwith return the balance funds to the parties that donated or contributed the same.
